Construction noise: plan it before work starts
Construction noise can restrict working hours and disrupt programmes. See how BS 5228, Section 60 and Section 61 fit into a practical site plan.

Construction noise becomes a programme problem long before it becomes a complaint. If breaking, piling, cutting or deliveries are left as details for the site team to manage after mobilisation, the available working hours may already be wrong, the chosen plant may be difficult to screen and the sequence may depend on an activity the local authority will not accept as proposed.
The practical answer is not to promise a silent site. It is to identify the noisy work, understand who could be affected, choose the best practicable method and agree how the work will be controlled. That may sit in a planning condition, a construction environmental management plan or, on suitable projects, a prior consent under Section 61 of the Control of Pollution Act 1974.
Two different noise risks
Construction teams often mix up environmental noise and occupational noise. They are related, but they are not the same assessment.
Environmental construction noise is about the effect beyond the working area: residents, schools, hospitals, offices, hotel guests and other sensitive users. The assessment considers the source, duration, time of day, existing sound environment, distance, screening and the character of the noise. In England, the government’s planning guidance on noise makes clear that impact cannot be reduced to one universal number. Frequency, duration, timing and local context all matter.
Occupational noise is about the exposure of people at work. It falls under the Control of Noise at Work Regulations 2005. The HSE construction noise guidance follows an assess, control and review approach, with elimination and reduction at source taking priority over hearing protection.
A boundary monitor does not tell you whether the breaker operator’s daily exposure is safe. Ear defenders do not control the effect on the care home next door. A competent plan has to address both.
What Section 60 allows a council to do
Section 60 of the Control of Pollution Act 1974 gives a local authority powers to control noise from construction and engineering works. A notice can specify:
- the plant or machinery that may or may not be used;
- the hours during which work may take place;
- noise levels at the premises or a specified point;
- the steps required to minimise noise.
That is why noise cannot be separated from the construction programme. A restriction on hours changes output. A restriction on a percussive method changes plant, labour and duration. A required screen may change the compound layout, access or lifting plan.
The government summary of how councils deal with construction noise also explains that failure to comply with a notice can lead to prosecution. Waiting for complaints before producing a method is not a sensible project control.
What Section 61 consent does
Section 61 of the same Act provides a route for a person intending to carry out the works to apply to the local authority in advance. The application describes the works, the method and the steps proposed to minimise noise. The authority can give consent subject to conditions.
Section 61 is not a universal permit that every construction site must obtain. It is also not a way around planning conditions, safe working requirements or the need to control employee exposure. It is a project-specific agreement about the proposed construction noise method.
Used properly, the process forces useful decisions before mobilisation:
- which operations are likely to dominate the noise impact;
- what plant and method will be used;
- where fixed and mobile plant will sit;
- when each noisy activity will happen and for how long;
- what physical controls will be installed;
- how levels and complaints will be monitored;
- what happens if the method, plant or programme changes.
Early discussion matters. The application needs enough detail for the local authority to understand the work, and any planning-condition discharge may run on a separate path. Treating consent as a form to submit immediately before breaking starts leaves no time to change the sequence if the proposed controls are not accepted.
Where BS 5228 fits
BS 5228-1:2009+A1:2014 is the current British Standard code of practice for noise control on construction and open sites. Its scope includes control methods, liaison, prediction, measurement and assessment.
The standard is guidance, not a single statutory decibel limit for every site. It can still become commercially important when it is referenced by a planning condition, consent, contract, employer’s requirement or construction environmental management plan.
A useful pre-start assessment should be based on the actual method, not a generic list of plant. For each significant operation, the team needs reliable noise data, the expected period of operation, the distance to sensitive receptors and the screening that will genuinely exist at that stage. A cabin that could provide useful screening in month three is no help during week one if it has not been installed.
Where the work is complex, close to sensitive premises or dependent on extended hours, use a competent acoustic consultant. A prediction that ignores overlapping plant, reflections or the real operating cycle may look precise while giving the programme no protection at all.
Controls that work on a live programme
Noise control is strongest when it changes the source or the route before relying on monitoring.
Change the method. Saw cutting, hydraulic bursting, crushing or boring may be quieter than repeated breaking or impact methods, depending on the material and task. The quieter method may take longer, so the choice belongs in the tender and programme rather than in a toolbox talk on the morning of the work.
Use the site layout. Put static plant, cutting stations and generators away from sensitive boundaries where practicable. Use solid hoarding, acoustic barriers, cabins or material storage as effective screening, provided access, fire safety and visibility remain acceptable.
Sequence the loud work. Concentrating a noisy activity into an agreed period can be better than allowing it to appear unpredictably throughout the day. It also lets the project give useful notice to neighbours and protect particularly sensitive times.
Control duration and idling. The loudest plant is not the whole problem. Reversing alarms, idling engines, radios, dropped materials and poorly maintained equipment can keep the site audible after the main task stops. Shut down unused plant, maintain silencers and covers, and organise delivery routes to reduce unnecessary reversing.
Plan the barrier properly. A barrier works when it breaks the direct line between source and receiver and has no large gaps. A short panel placed beside a machine for a photograph is not an acoustic strategy. Its position has to follow the changing workface without creating a plant, pedestrian or lifting hazard.
Monitor against an action plan. Measurement is useful only when the team knows what happens after an alert. Set responsibilities, reporting routes and proportionate actions before work starts. The first response may be to check the operating method and monitor position, not automatically stop the entire site.
Do not copy another council’s working hours
Standard construction hours vary by authority, location, planning permission and the sensitivity of neighbouring uses. They are not one national allowance.
For example, the City of London construction guidance publishes its own standard and reduced-impact hours, together with local notice and liaison expectations. Those requirements are useful evidence of how detailed local controls can become, but they are not the rule for a site in Essex, Hertfordshire or anywhere else.
Check the planning decision, approved management plans, local authority guidance, tenancy constraints and any consent before fixing the programme. Where a concrete pour, utility connection, possession or safety-critical operation cannot fit the normal window, agree the route early rather than assume the activity will be treated as an exception.
The pre-start noise check
Before mobilisation, the project manager should be able to answer seven questions:
- Which activities are likely to create the greatest off-site impact?
- Who are the sensitive receptors at each phase of the work?
- What working-hour restrictions already apply?
- Is a planning submission, Section 61 consent or other prior approval required?
- What quieter methods and physical controls have been allowed for in the price?
- Who owns monitoring, neighbour liaison and the response to complaints?
- What programme change is available if the proposed method is not accepted?
If those answers are missing, the noise risk has not been priced or programmed. It has only been passed to the site team.
Plan the method before fixing the date
